ALIMONY
Spousal support, often referred to as alimony, may be awarded during or after a divorce to help one spouse maintain financial stability. In Tennessee, alimony is not automatic. The court considers several factors, including the length of the marriage, each person’s income, work history, education, and ability to earn a living after the divorce.
Types of Alimony in Tennessee
There are four main types of alimony in Tennessee. Rehabilitative alimony is meant to help one spouse gain the skills or education needed to become financially independent. Transitional alimony offers short-term financial support during the adjustment period after divorce. Alimony in futuro, sometimes called periodic alimony, may be awarded when one spouse is unlikely to become self-supporting due to age, health, or time away from the workforce. Alimony in solido is a fixed amount, often paid in installments or a lump sum, and is not subject to modification.
How Alimony Is Decided
Courts review many factors to decide whether alimony should be awarded and what type is appropriate. These factors include the standard of living during the marriage, the age and physical condition of each spouse, financial need, and earning ability. The court also considers contributions made by each spouse, including unpaid work in the home and support of the other spouse’s education or career.
